On November 12, 2014, a High Desert State Prison corrections officer shot Andrew Arevalo repeatedly in the face with a shotgun while he was handcuffed behind his back; the same CO killed inmate Carlos Perez. Rather than call for an ambulance, the CO drafted murder charges against Arevalo. Attorney Alexis Plunkett was the first person to reveal this horrific violation to the media, subsequently filed a lawsuit against the Nevada Department of Corrections, and was immediately targeted by the entire State. Ms. Plunkett was repeatedly falsely accused of crimes involving NDOC from 2015 to 2016.
In 2017, Ms. Plunkett misread a waiver allowing her to use her cell phone inside the Clark County Detention Center, and the State filed 14 felony charges against her. Ms. Plunkett received multiple random death threats and threats of sex assault. The judge dismissed the case in 2017; the State appealed to the Supreme Court and the case was returned to District Court fourteen months later. In 2018, the State sought to revoke Ms. Plunkett's bond based on a text message sent when Ms. Plunkett was not on bond, nor did she have an active case against her. The judge denied the motion.
In 2019, the State filed a new felony case against Ms. Plunkett for a 2018 public Facebook post, alleging Ms. Plunkett threatened a witness. Once again, this information is absolutely false. Ms. Plunkett has been defamed in the media and disputes much of how her alleged crimes have been described in the media, in addition to how the State has characterized her.
The State has turned Ms. Plunkett's clients against her and placed her life in danger. Due to the ongoing and severe harassment, Ms. Plunkett felt obligated to take a deal in order to protect herself and her personal safety. Ms. Plunkett looks forward to leaving the State of Nevada and never returning.
